An employee who is resigning while refusing to sign a noncompete agreement can use this letter template to explain why, including citing legal precedent when relevant.

Thank you for accepting my resignation effective two weeks from today.
I’ve reviewed the noncompete agreement, but I am unable to sign it. There are several terms and conditions therein that would negatively affect the trajectory of my career. Had I been presented with this document when I was hired, I would have declined the offer of employment.
Moreover, noncompete agreements are unenforceable in this state.
I hope that there are no hard feelings around my refusal to sign. Please rest assured that I hold the company in high regard, and have no intentions of doing anything that could damage your business or reputation.
